Every fresh graduate wants to get a good job with high starting salary. Everyone expects as such. Now, everything is money. Without money, u r nothing. Girls will not even look at u (joking). But, yes.. money is extremely crucial today. A happy person may turn to be an unhappy person if he or she is poor, lazy, and doesnt have money. Money will be ur main concern if u live in city. The cost of living is getting higher and higher.

So, u shd have a high purchasing power. In jb, if u just earn 3k per month, and u r married, n ur wife is just a housewife, jobless, i have no idea how u r gonna live. I mean, u still can survive, but u will have a moderate way of living. It is much more worse in KL. With 3k income, u can only afford to own a flat. A low cost flat. dont be shocked if i tell u guys, 15k per month will just give u a terrace house in KL or JB. So just imagine how high the living cost is.

So,everyone concerns about money. Thus, income wd be a crucial subject among students who r about 2 finish their study. Many want to join private while the rest prefer to be in govt. Ive gone through internship programmes at two place this year. First, ministry of foreign affairs( we used to call it wisma), while secondly, at a medium size law firm, syed alwi ng n co. So, I am interested in making a comparison between salary given by d govt and private sector.

Well, It is a common perception that we r gonna get a good starting income if we join the private sector. Its not always true. Some big companies give an unreasonable salary which is quite low as compared to what the govt does. Nowadays, some assume that thing seems to have turned otherwise. They say you may get a high starting income by working with the govt. Just look how much does a fresh teacher get. Its even more than the amount a fresh lawyer gets.

We can see some stingy small law firms give a very small amount of payment to the chambering students and the legal assistants. But when it comes to some well known firms, the salary will be a bit higher. Maybe just a one or two hundreds more. This is the worrying trend that im seeing in our legal profession. Thats the reason why most of law graduates tend to join the government sector to start their carrier. They can get almost 3k per month once theyve been confirmed to their position.

Despite that fact, most of them do not realize that the increment isnt that much. But if u work with a law firm, even though the starting is considered small, we shd put in mind that the increment is quite high. it all depends on ur performance.the harder u work, the more u will get. Unlike the govt sector, where it is based on ur seniority. It wd be extremely sad to know that u just get 5k or 6k after working for 10 years. Uve been working like hell n yet u r given a very little amount of money. Its just not worth it.

Many senior lawyers have a very satisfied income after at least 5 years of working experience. This is the main reason why senior legal officers in AGC quit after working for like 10 years to open their own legal firm. Because they can make much more money by doing that. those who want a high starting salary wd definitely work with the government. After a couple of years, u can see, most of them will quit.

However, u will get many privileges by working with d govt. High housing loan, pension, allowances etc. plus, in case of economic downturn, u r not gonna lose ur job. u cant get those things in private. so, there will be advantages and disadvantages. Its all up to u.

its been a while since the last time i posted article on this blog. Like 5 months. Its a freaking long period. Life was so busy back then. Only now i have the chance to write. Coz theres nothing to do, nothing to think, nothing to be worried about. My life is so free. All i wd do when i feel bored is just sleeping. Just imagine how free i am. Lepaking, watching football, talk rubbish - Are my activities these days.

Its ramadan now. Yes. Happy ramadan guys! Its quite late i think . ive not had ramadan at home for a very long time. The last time was in 2003 if im not mistaken. And i still remember the days when i was form 3 where that was the first time i had ramadan in school. That was in fact so fun and exhilarating. Breaking fast with friends, performing tarawikh together. Really miss those days. The coolest thing we did was we skipped classes, going to surau, n sleeping in a small room in there, we called it bilik azan. That was in 2006 where everybody was freaking busy preparing for the spm. Lol. Honestly, i feel like getting back to those days..lol

Actually, ive nothing interesting in mind to come up with an interesting article. So this is just a random thoughts from me. I just write what my mind tells me to write. I mean like, spontaneously. i dont wanna write something heavy and serious such as commenting on the current and global issues, analyzing the national politics... what the... Only old and boring people wd do that. its just not cool.

Now, i am back to this blog. i used to be active writing on blog more than one year ago. And i admit that blogging is fun. I promise u guys, i will keep writing. But i wonder why people tend to decorate their blogs with some fancy colors and unwanted things like live traffic etc. its like a trend. Ive been stalking to many blogs and i notice that most of the blogs are colorful. The best thing is those blogs have what they call as live traffic. Enables u to know who has been stalking u. Not the exact person but it tells u where the stalkers are from. This is.. Cool. Oh.. i want to do the same lah.. kahkahkah

And u know what, i just realized that i havent started doing my report yet. I mean the attachment report or whatever u call it. I havent even filled the activities in the funny report book. I just dont understand why there are so many columns in it. Its exactly like a silly diary where u have to write every single thing u do in every hour! Ok.. think positively. I guess, that makes a good lawyer. Pfthhhhh..

messages in songs

Listening to song is something that i love to do. I love music as well as singing even though i do realize that my voice is not that nice. Some people asked me why do i like to sing. I don’t have single answer to this question and there might be few reasons. The main purpose of going karaoke is just to relax my mind. Whenever i sing i can express something which is hard to be expressed by words. One of the ways to express them is by singing. That is why we should understand the messages contained in the lyrics.

I realize that song is not just a song. Singing does not merely mean singing. Some singers sing for the purpose of conveying messages. There are many songs which contain very beautiful and meaningful lyrics. Many people do not aware this. Most of us just like the rhythms of the song and we do not give a damn to the meaning of the song. The messages are ignored and not conveyed.

When we listen to songs, we will notice that most songs are love songs. Malay songs especially. There are always stories of falling in love, missing someone, and breaking up, in a particular song. These kinds of songs are too many. However, a song might sound like a love song but actually it is not. There will be some hidden meanings in the lyrics which encourage the listener to think what the meanings are.

If you listen to m nasir songs, you will be surprised to know that most of his songs are about praising the god, the importance of taqwa, and tawaqqal. The lyrics are really beautiful and impressive. Some songs are obviously love songs. But actually, they are about loving the god. Some songs tell you about how difficult it is when you are tested by god and how peaceful and calm you will be when you accept whatever thing that happens to you with an open heart. These songs do not sound like nasyid but the content is about praising the god. It is just people do not call him a nasyid singer.

M nasir is not just a singer. He is a song writer, a song creator as well as a preacher. He does not wear kopiah and his appearance does not look like a nasyid singer. But still, he is a preacher. He preaches islam by way of singing. His sincerity in preaching islam can be seen in all lyrics that he has written. Someone does not have to be a nasyid singer, wearing kopiah to preach the religion of islam. The most crucial thing is intention.

Intention

Allah awards us with so many things. If we were to count all the nikmah that Allah has given, we will not be able to count them. We are here in this world because of him. We come from him and once we die, we will get back to him. Everything that exists in this world belongs to Allah. Thus, we should not be arrogant with all things that we have. All the properties are temporary and Allah can take them back anytime.

Some people tend to show off expensive things including me. Of course, if we have something expensive, there will be at least a bit of ‘menunjuk’ habit among us. This is quite bad and should be avoided. Islam encourages donation when we have something that exceeds our necessity. With regard to this, sincerity is very crucial. Not only in donating something, but also in everything that we do in our life.
There’s one hadith saying, innamal a’maalu bin niat ( every act begins with intention). This hadith shows that intention plays a big role in our life. If someone has a bad intention, he or she tends to do something bad. Every action goes back to the intention itself. Thus, if our intention in doing everything is just for Allah, i am sure that every single action that we do will be blessed.

There are some misconceptions among muslim where they think that doing something in the name of Allah is only for ibadah, performing prayers, fasting, etc. If they think as such, they have misunderstood the concept of ibadah. Ibadah itself covers many things. Ibadah is not only limited to solat, fasting etc. One who does something in the name of Allah can be said to have done an ibadah. Reading itself is an ibadah if you read with the intention of complying the quran verse which encourages people to read. When we take bath for the purpose of cleaning ourselves, we can be said to have complied a hadith.

We should realize that Islamic values are universal values. Islam teaches us the way of living. Living with sincerity means living in the name of Allah. Living in the name of Allah will always make us feel calm and we will accept whatever test that is given to us. InsyaAllah.

Recently, raja petra who is well known as rpk, a fugitive blogger challenged the govt to try his case in uk court.
He has been staying there for about a year running away from bein caught by malaysian police. The police has is still searching for him n want to bring him to court to b charged.

Rpk said that the reason why he runs away from msia is bcoz he doesn't believe to our judiciary. If he stays here, he ll b charged n definitely ll b convicted. Rpk chickened out. He's a chicken of the first order.

In the past he had been shouting like hell criticizing the govt n its instruments. All r rotten n he will blame all things which do x favor him. He made wrongful allegations which r totally baseless n I can describe him as a tool for certain irresponsible individuals.

He has been caught by d police be4 n the police has completed their investigation n rpk needs to be charged. He's is so coward for running away. If he feels that he's innocent just go for the trial. He is x guilty until proven guilty. So simple.

he wants to be tried in uk. That's stupid. Does uk court hv any jurisdiction to try him? No, they don't. He's not a war criminal. He's fugitive perhaps. That's y he had courage to say as such. There's x legal provision which allows the uk court to try him.

N I've x idea how he could stay there for a long period n how did he escape from msia.

University ranking

University ranking is one of the hottest issues this week. The 2010 asian uni. Ranking (rum) has been released n it shows 5 local uni have succeeded 2 place themselves in top 100. However d ranking of some uni such as um n ukm has dropped. I'm quite disappointed with how d local medias deal with this. It was reported in d back pages of only 1 mainstream newspaper. Were they unaware of this?

when uni ranking drops, people will condemn n question its methodology. the criteria to evaluate d uni ll b changed every year. Perhaps this is d main reason y d uni ranking drops.

However, we must realize that d rankings r x a perfect measure of a uni actual worth. Sometimes, its kinda subjective to measure such uni. There r some universities which r good in 2 or 3 fields where they hv specialized their expertise. For example, iiu can be said as 1 of d best universities in msia where they hv produced so many experts but they r x listed in d top 100. Last year they were placed in top 300. But we can't say they r x good n as far as I'm concerned iiu graduates r marketable. They use fully english when it comes to learning n teaching n they have x prob in speaking english, soft skill etc.

A deeper context of evaluation must b made. N they r looking 4ward of it. More aspects n elements should b measured. University's work at national level, community engagement etc must b taken into account.

Malaysia Raises Rate as Faster Growth Eclipses Europe Threat

May 14 (Bloomberg) -- Malaysia's central bank raised interest rates for the second time this year as growth accelerated, judging that risks stemming from low borrowing costs are greater than any impact from Europe's debt crisis.

Bank Negara Malaysia increased its benchmark overnight policy rate to 2.5 percent from 2.25 percent, it said in Kuala Lumpur yesterday, a decision that was predicted by 21 of 22 economists surveyed by Bloomberg News. Gross domestic product increased 10.1 percent in the three months ended March 31 from a year earlier, the most in a decade, a separate report showed.

Asian central banks are pulling back monetary stimulus as the region's growth outpaces the rest of the world. Malaysia will be able to absorb increased volatility in its markets as a result of the turmoil in Europe, and has the "policy flexibility" to act should global conditions worsen, Bank Negara Governor Zeti Akhtar Aziz said yesterday.

"The economic upswing looks set to remain strong and Bank Negara needs to tighten further to ensure that inflation stays contained," said Kevin Grice, an economist at Capital Economics Ltd. in London. "The chance that inflation accelerates significantly in the coming quarters appears a far greater threat than the risk that either local policy tightening or what happens in Europe brings a sharp slowdown in GDP growth."

The impact of Europe's sovereign debt crisis may be muted on Malaysia, Goldman Sachs Group Inc. said this week as it recommended buying the ringgit. Global stocks fell last week on concern the debt crisis in Europe would derail the world's recovery from last year's economic slump.

Ringgit Climbs

The Malaysian currency is Asia's best performer this year and has climbed 7.4 percent against the dollar. It rose to 3.187 per dollar at 7:46 p.m. local time yesterday, from 3.199 before the GDP data and rate decision were released.

Malaysia's ringgit is "retracing back" to previous levels after depreciating "very significantly" in 2008 and part of 2009, Zeti said yesterday.

Europe's sovereign debt crisis may increase capital flows to Asia at a time when policy makers are battling rising asset prices and strengthening currencies, according to Standard Chartered Plc. European lawmakers announced an aid package worth almost $1 trillion on May 10 to stem a drop in the euro and avert a default by Greece.

"At this point, we do not see the risks on our domestic economy rising from these developments in Europe," Zeti said. "But if this contagion spreads to other parts of the world, including to the U.S. and other developed economies, then we need to reassess the situation."

Early Mover

Malaysia was among the first Asian countries to withdraw monetary stimulus this year. The central bank's rate increase in March was the first in almost four years.

"By starting early, Bank Negara has the flexibility to move gradually and can amend its tightening strategy if conditions change unexpectedly," said Grice, who expects rates to be raised to 3.5 percent by mid-2011.

The Bank of Korea left rates unchanged for a 15th month this week. Bank Indonesia has refrained from raising borrowing costs even as its economy expanded at the fastest pace in more than a year last quarter. Still, India and Vietnam have raised interest rates to contain inflation, while China has ordered banks to set aside more reserves three times this year.

Malaysia's rate increase is a move "towards further normalization of monetary conditions," the central bank said in a statement. "The stance of monetary policy continues to remain accommodative and supportive of economic growth."

Growth Forecast

Zeti said last month the central bank may raise its 2010 economic growth forecast from as much as 5.5 percent as exports and industrial production strengthen. Growth of 6 percent this year is "achievable" and the government is on target to narrow its budget deficit, Prime Minister Najib Razak said yesterday.

Overseas sales jumped 36.4 percent in March on growing demand for goods including IOI Corp.'s palm oil and Intel Corp.'s computer chips.

"Malaysia can take comfort that its growth looks quite strong in 2010, supported by domestic demand and the outlook for the rest of Asia," said Rahul Bajoria, an economist at Barclays Capital in Singapore. "We see a further normalization of the policy stance, possibly in the third quarter, but the timing will depend on how global conditions pan out in the coming months."

Future rate increases will be more dependent on domestic conditions than international ones, Zeti said yesterday. The economy is expected to improve further in the current quarter from the first three months of the year, she said.

The central bank said it expects a "gradual rise" in consumer prices this year and overall inflation will probably be "moderate" even as global commodity and food prices increase cost pressures.

MMC May Propose $1.2 Billion Power Plant Expansion (Update1)

April 29 (Bloomberg) -- MMC Corp., Malaysia's second- biggest electricity producer, may propose to the government a plan to spend as much as $1.2 billion to expand its Tanjung Bin coal-fired power plant to avert a potential supply shortage.

A power reserve shortfall may emerge as electricity from the Bakun hydroelectric dam on Borneo island may not be transmitted to Peninsular Malaysia as planned, Hasni Harun, who will become MMC's group managing director on May 3, told reporters in Kuala Lumpur today.

"We need more power in the future, and since Bakun is not forthcoming here, this side of the region needs more power," said Hasni, chief executive officer of MMC's Malaysian operation. "We are hoping for the government to make a decision fast and invite all the independent power producers to submit a competitive bid to build additional capacity."

MMC's power unit, Malakoff Corp., may expand the 2,100- megawatt, coal-fired Tanjung Bin plant in the southern state of Johor by adding 800 megawatts, Hasni said. Malakoff owns six power stations with a capacity of 5,020 megawatts, equivalent to 25 percent of the generation capacity in Peninsular Malaysia, according to its 2009 annual report. In 2007, Malakoff was taken private by MMC.

Malaysia emerged from its first recession in a decade in the final quarter of 2009, spurring demand for energy. Electricity demand for the first six months ended Feb. 28 grew 8 percent from a year earlier, national power utility Tenaga Nasional Bhd. said on April 20.

Shares of MMC, controlled by businessman Syed Mokhtar Al- Bukhary, fell 0.8 percent to 2.44 ringgit as of 3:06 p.m. local time. They have gained 44 percent in the past 12 months.

"With power from Bakun not available for the peninsular, there is a risk that by 2015, the reserve margin will decline to below the 20 percent threshold," Hasni said.

What is meant by morality.? Act, there's x single definition. Everyone has their own perspective on this. Law n morality r inter related. U can't separate both of these things. A society may suffer for moral crisis if morality is ignored. Qs arise should we legalize something immoral. Should we permit homosexual? Should we legalize gay n lesbian? Should we allow transsexual? No. We shouldn't. But those who believe in immorality say we should. It is justified to uphold so called supremacy of human right.

Their argument is that it becomes their right to be wht they wanna be. Human right is being used as a tool to justify immoral acts. they say the govt shall x interfere with their way of life. If that's the case, it definitely will amount 2 moral crisis.

If a society is led by an immoral leader, social aspect of the people d b affected as well. Immoral acts ll b made permissible n this is a threat to human civilization. Personally I don't trust a leader who believes in immorality.

Tomorrow, 31st of august we Malaysian will celebrate our independence day. it has been 52 years our country has freed from the colonization. Today, Malaysia has developed rapidly and well known by the world. Our achievements are undeniable and we have become role model in many things. We are now moving towards vision 2020 in attaining the developed nation status.

Since independence we have attained so many achievements. Nearly forty years ago, we moved very slowly. We don’t have enough expertise among Malaysians to help the government in developing the country. We faced many difficulties during that time. May 13 racial riot also has deteriorated the situation and scare us till now. From the past, we learn from mistake. Our government has taken action and did their best to make policies which can ensure our competitiveness in economy for the sake of the people.

Government also is looked concern in promoting the social welfare where the rate of poverty has decreased drastically. The national education policy has succeeded to form intellectual societies. Since 1960, our local universities have born many experts as well. This achievement has undoubtedly contributed a lot for the development in many fields.

The movement to attain independence was very difficult. We face many challenges and tribulations. Some nationalist, leaders, and armies died in their strive to attain the independence. We cannot forget their contributions to free this country and their efforts will be remembered forever. They are willing to do everything. Many nationalists such as Dato’ Onn Jaafar and Tunku Abdul Rahman had led the people to oppose the Malayan Union and made them realize that people in Tanah Melayu want to be independent.

However, we also cannot forget the efforts and contribution of left movement’s leaders during that time. Dr. Burhanuddin Al-Helmy, Ahmad Boestamam, and Pak Sako had strived to free this nation from imperialism. Nowadays, young generations think only Umno strive and led the people to push for independence. But, not only Umno. Before Umno was formed, many associations like API, AWAS, and Parti Kebangsaan Melayu Malaya (PKMM) played important role to increase the awareness of the people about the bad impact of colonization, imperialism and so on.

It must be noted, even the weak become strong when they are united. Therefore, unity will help a lot in the development of economy, social, education system, etc. Today there are many problems, disputes and crisis which plague us. As a multiracial country which lived by 3 main races we face such big challenge in ensuring a better future for Malaysia. Peace and harmony need to be guaranteed. Racial integration must be consolidated and strengthen.

Right now, racial issues and religious issues are still being played especially by politicians. If this happen continuously, our nation is at stake. We cannot prejudice our future. Basically, we don’t have difficulty to encourage unity. The problems appear when it comes to politic. Sometimes differences of opinion cause uncomfortable atmosphere and it makes hard for them to live together.

Independence means not only free from the colonization. it must be defined broadly. Independence also means we are free from corruption, abuse of power, poverty, mismanagement, crime, riot etc. we cannot let this things happen. Independence includes respect for human rights, human dignity and social justice as well. We must uphold the supremacy of the constitution, rule of law and equality before the law.
This country should be governed by law.

We need to comply and respect what has been enshrined in the federal constitution which becomes the supreme law of the land. A truly independence judiciary must be put in place. Besides, the government and the people should also understand the constitution and constitutionalism. We must ensure that the people do not live in fear. Crimes should be prevented seriously. The people should be given freedom subject to limitations provided by the constitution. This is the real meaning of independence.

Right to information and cyber freedom -Part 1

Nowadays, access to information is becoming easier. World now is well known as no boundary. In most developed and developing countries internet is a necessary and without internet people will face difficulties. It is undeniable that internet play important role in managing all businesses in our daily life. It has something to do to form an informed citizenry as well. The access to the internet has widened from day to day and right now people have very wide access to information. Any latest news are kept updated from time to time which enables the people to know what is going on around them. This development also has eradicated the communication barrier where people don’t have to take so much time to convey such information among them through email etc.

Recently, the government proposed to censor websites which contain pornography elements. This suggestion got many reactions from the people. Those who disagree think that the proposal not only restricts the pornographic elements but also the restriction of all materials which harm to the public. This broad definition may include seductive articles or any writing seems to criticize the government. This what they think and in their opinion, the intention of the government is not to censor the porn but to restrict access to political blogs or website. They just use this ground in order to shut the people voice.

This issue deals with freedom of speech and expression. Federal constitution has enshrined this kind of liberty in the article 10. However article 10 needs to be read as a whole together with some limitations. Generally, in constitutional law, freedom of speech and expression is a combination of many rights in many forms. It includes so many things such as communication by word of mouth, signs, symbols and gestures and through work of art and so on. Press freedom is one of them but the constitution silent about this where there is no mention in the constitution about freedom of press and electronic media.

The drafter of the constitution couldn’t foresee the development of cyber technology. That’s why there is no clear provision in the constitution to govern this. But we do have a few acts such as defamation act, sedition act, computer crimes act etc as a guideline. The cyber world has globalized the information and simplifies the way for the access. At the same time, some people abuse this rights by circulating rumors, alleging someone falsely, defaming, reveal confidential and secret things and so on. i think it’s not too late for me to comment on the recent by election. It’s Just a short note. Pas has retained the permatang pasir seat. Even though the majority decrease but they are still the winner. This is expected since the majority previously was about five thousands something. Actually the victory of pas was also contributed with the issue of BN candidate’s disbarment from the legal practice. If this issue not arises, I expect that most probably the majority will be lesser. We could see PAS played this issue every day since the election campaign started. This has affected Rohaizat’s reputation and credibility which implicitly causes the voters to lose their hopes and confidence towards him. What makes me curious is why BN choose that kind of person as candidates. Is he the best choice that BN can put as candidate? we must remember whenever by election is held many people will concern and keep focusing to that constituency to follow on what is happening from day to day until the election day. Every eyes focus to that area and indirectly the election’s result has a big influence towards the voters as a whole. That’s why every political party cannot take it for granted. Since the last GE, Pakatan Rakyat has won 8 times and lost once. BN has been given so many opportunities to restore the public confidence. Seems that they are not really serious in convincing people that they are still relevant. If BN keep losing continuously in other by election next time, don’t get shocked when suddenly a day after next GE, they are no longer in power.

Hudud laws based on constitutional perspectives

Hudud issue is not a new issue. It has been debated for quite long. A few years ago, PAS, an Islamic political party introduced an enactment relating to hudud laws. What actually hudud means? Hudud generally is laws relating to crimes, punishments and rights and duties that are mention in the quran. During PAS’s administration in Kelantan and Terengganu, there are 3 versions of hudud. First, syariah criminal enactment 1993 which contains 72 articles. Second, the bill tabled in 2002, named syariah criminal offences enactment bill (hudud and qisas) containing 74 articles. The last, syariah criminal offences enactment ( hudud and qisas) which contains 67 articles. The state government during this time claimed that they have power to enact such laws. In this writing I will comment on this based on constitutional perspective.

Legally, my stand towards hudud is, it cannot be enacted in Malaysia. Malaysia is a federation comprising 14 states and have dual systems of government, federal and state government. When talking about hudud, we are dealing with constitution and federalism. Malaysia as a federation has strong central government than the regional government. Constitution is the highest law as stated in article 4(1) and any law which contradict with the constitution, state law contradict with the federal law, and any law which is made not within the jurisdiction shall be null and void. All these are provided in our constitution which is the supreme law.

Reasons why hudud cannot be enacted in Malaysia. First, schedule 9 in the federal constitution provides that state legislative has power to make law relating to the punishment and offences by person professing and practicing the religion of Islam against percept of that religion except in regard to matters in the federal list. This means, state has power to make and enact any law but subject to the matters which included in the federal list. Any matters contained in the federal list, the state has no power. In list 1 of the constitution, among matters which included in the federal list, administration of justice, jurisdiction and power of all courts, criminal law and procedure, creation of offences in respect of any matters are in the federal hands.

Federal penal code has made it clear. Any criminal offences like rape, incest, gross indecency, murder, homicide, robbery, and theft are stated in the penal code which is the federal law. This is in accordance with the list 1 or federal list. Let say hudud is implemented in state. We need to deal with the criminal offences which within the federal list but hudud law is law enacted by state. It is clearly unconstitutional. This is an intrusion towards the federal power.

If we look to the list 2 of ninth schedule, syariah court has jurisdiction towards muslims only means person professing the religion of Islam. This has been stated by the court for example in the case of subashini, it was held that non Muslim cannot be brought to the syariah court. That means syariah court has no jurisdiction over non Muslim. If hudud is enacted by state, Muslim offender will be charged in syariah court and non muslim will be charged in civil court. Where is the equality before the law and equal protection of the law?

Next, the syariah law is not naturally provided. It must be derived and subject to the federal law. Refer to the ninth schedule in list 2 clearly provides that sayriah court has no jurisdiction in respect of offences except in so far as conferred by federal law. Syariah courts act 1965 (criminal jurisdiction) is a federal law. The limit of punishment imposed by this act towards the syariah court is it can only sentence maximum 3 years jail and rm5000 fine and 6 lashes. That is why the syariah court can only impose punishment towards offenses such as khalwat, arak, not fasting, missing Friday prayers and etc. The syariah court cannot impose punishment other than permitted by this act. This is the consequences by this limit. Meaning that, any punishment other than these permitted penalties shall be unconstitutional. Hudud law comprises the punishments like amputation of hands, stoning, or death sentence for qisas are outside the permitted limit. So implicitly, it against the federal law and therefore shall be unconstitutional, null, and void.

The next issue aroused is the enforcement of the hudud laws. The question is who has the jurisdiction to enforce such laws? It will cause constitutional dispute when it comes to the enforcement, the arrestment and detention of the hudud offenders. The problem may be settled if the state set up their own enforcement unit. But surely they will seek help from the federal police. Indirectly, constitutional problem will arise since the police’s powers are derived from the federal constitution and federal laws like police act 1967. Lastly, the ninth schedule list 1 of the federal constitution provides that, police, prisons, remand homes, and places of detention are in the federal list. If the state wants to run their own detention centre, it will be outside the power of the state authorities and therefore is submitted unconstitutional.

If we still want to enact hudud laws, we will face so many difficulties. It is not easy to enact. Hudud laws cannot be enacted by state and state needs the help from the parliament to enact hudud. The implementation of hudud in Terengganu and Kelantan has been challenged by Zaid Ibrahim in court but the case was revoked by him. The implementation of hudud can be done constitutionally by amending many provisions in the constitution. That is why it is difficult and to amend since any constitutional amendment needs to get the support of two thirds lawmakers in parliament. This is almost impossible.

Perak Crisis: Whats Next?

The perak crisis continues without solution. When this will end we don’t know. On 11th of may the court ruled that Nizar was the rightful MB. All pakatan’s supporter were happy but that good mood turned bad the day after where the high court decision was suspended while waiting for zambri’s appeal to be decided by appellate court. A week later, the appeal court overruled the high court’s decision and declared zambry as legitimate MB. All 3 judges allowed the appeal. Now, its niizar’s turn to appeal and bring the case to the apex court.

One more time the judicial independence is questioned by Malaysian public. Some pakatan’s supporter said they don’t trust the judges. They only trust the high court’s judge which ruled nizar as rightful MB. Pas vice president said, the situation in the court is much different where we can see many umno leaders there. This situation didn’t happen previously in the high court. It seems, they have already known the verdict. Just being there waiting for the decision to be announced. At this point, I still believe the independency of our judiciary by looking at the judgment. It is not baseless and has strong reasons. We cannot just simply say our judiciary has collapsed. Look at the judgment first before making any stand.

In the high court’s decision, it was held that nizar is still the MB where nothing was done to vacate the MB seat. Vote of no confidence was not made since this is the way to remove the MB. The judges upheld the Stephen kalong ningkan case. The appeal court then held that zambry is the legitimate MB where the court stated that the sultan was correct in appointing Zambry where the sultan had called 28 BN state assemblymen including the 3 frogs and found that Zambry got the majority as MB. There was no express provision in the perak constitution which require the vote of no confidence as the only way to remove the MB. The failure to command the majority can be determined by other means.

But the legal implication by this verdict is the YDPA can remove the prime minister after finding that the prime minister has no longer got majority. The same thing happen to the state where sultan can remove the chief minister. UMNO’S lawyer said the right to choose PM and MB is the ultimate right of YDPA and sutan. This is a great quote where it gives serious implication for the parliamentary democracy. By this decision, does YDPA have absolute power to choose prime minister that he wants? What about if some BN’s lawmakers in parliament jump to Pakatan and then YDPA ask the PM to step down. No need vote of no confidence. Could this kind of thing happen? Definitely not. Is Malaysia constitutional monarchy or absolute monarchy?

Today perak has been plagued with crisis for nearly 4 months. I believe that some of the perakians already getting bored with this situation. I heard so many types of people, academician, lawyers politicians talking about the need to dissolve the state assembly. Nizar, after the high court decision spoke to reporters that he wanted to meet the sultan to get consent to dissolve the assembly.

This crisis began with the political dispute where implicitly cause constitutional crisis. Personally, in my opinion, this cannot be settled through legal channel. It must be resolved through the political way. Sometimes when this crisis is brought to the court it will make the integrity of the legal system is questioned. We are democratic country. Even though not absolute, but basically still democracy. Abraham Lincoln described democracy as government of the people by the people to the people. So give the right to the people to decide. Right now, legally, BN may have majority in the assembly. But it is disputed whether they have the mandate of the people.

This has been such a deadlock. The crisis seems like no end. So why don’t let the people to decide. But it must be noted that even the re election is made, there is possibility that the winning coalition only survive with slim majority and maybe 1 or 2 state assemblymen will cross and cause the same thing again. However that is better than not to dissolve.
Personally, in my opinion if the perak assembly dissolved 3 months ago, all these kind of problems like the action of the speaker to suspend zambri, the issue of the speaker physically removed from the chair will not happen. One more thing, why BN seems so scared to face election. You also got chance to win. I dare to say, BN got bigger chance than Pakatan. You have newspapers published daily, tv channels, internet and whatsoever. BN needs to have self confidence.

I’ve always read in utusan where it was told that BN is still in the heart of the people. Every time by election was made after the 8thmarch GE, it was reported that hundreds of pakatans supporter jump to BN change their party. So don’t make the people think that you are coward. Is BN afraid to lose to the coalition which is described as irrelevant? So, please don’t scare. BN said they’ve got consent from the people to govern. The best thing to prove this is let the people to decide. If BN scared, they are afraid not to get mandate from the voters.

Some people said that holding a re election in perak is wasting the taxpayer’s money. That is the price you need to pay for the democracy to get the mandate of the people. What about the white elephant’s project that is functionless and corruption cases which make our country suffer. Abuse of power and whatsoever even though not proven, but still affect the confidence of the people about the transparency of the government in managing our country.

If this crisis keep continuing, the situation will become worse. It will affect the administration, management of the state, economic and Perakian. We must remember the 3 frogs do not become the member of BN. They only show their support towards BN and enable BN to claim they have the majority. There is possibility that they will cross over again isn’t it? That means their position is not strong. One more thing, the 2 frogs have been charged in court for corruption. If they are found guilty, their seats are vacated and by election will be held. I am worried if they lost, what will happen?

So the best thing is the sultan need to use his prerogative power under the perak constitution to dissolve the assembly in order to settle the political crisis.

Dalam ilmu ketamadunan, banyak pendapat daripada tokoh sarjana zaman silam mengatakan bahawa perlu wujud keseimbangan diantara pembangunan fizikal dan pembangunan akhlak atau rohaniah. Bekas Presiden Indonesia Mohamad Natsir mengatakan jangan kita ini membangun sambil merobohkan. Ini ungkapan popular yang menjadi sebutan pemimpin gerakan islam sekitar 70an. Konsep sedemikian mempertahankan kekuatan dan keluhuran akhlak sebagai benteng pertahanan mental,umah dan tamadun. Sarjana islam mengupas ungkapan ini dengan maksud mendalam menggambarkan, ekonomi pesat membangun, rasuah dan riba dibiarkan menular tanpa langkah penyelesaian, maksiat dibiarkan bergelimpang menyebabkan darjat umat ditahap asfalasafilin iaitu serendah rendah darjat. Ketidakseimbangan pembangunan dua unsur ini menyebabkan pembangunan tamadun terhalang. Dalam Decline and Fall Of the Roman Empire karya Gibbon seorang sejarawan Inggeris, sebuah kerajaan yang mulanya cukup hebat kemajuan ekonominya kamudiannya bila pemerintahan diganti oleh generasi berikutnya, rasuah menular, kezaliman merebak, dan akhirnya timbul bibit-bibit kelemahan yang menghancurkan tamadun tersebut.Dalam membicarakan soal ini khusus bagi yang muslim, prinsip dan dasar yang ditetapkan dalam islam sememangnya amat lengkap untuk memastikan keseimbangan pembangunan fizikal dan kerohanian. Maknanya, segala tindakan mesti berlandaskan prinsip islam, melakukan segala suruhan Allah, meninggalkan segala larangannya dan mengikuti sunnah Rasulullah S.A.W. jika ini dapat dilaksanakan pastinya segala kelakuan kita akan diberkati dan dirahmati. Dalam soal ekonomi umpamanya, jika ekonomi dibangunkan secara telus, mengelakkan sedaya upaya penyelewengan daripada berlaku, mengamalkan system yang adil dan tidak menindas seperti mengharamkan riba, pastinya ekonomi berupaya diperkasakan. Politik berlandaskan islam seperti berjuang untuk kebajikan rakyat semata-mata dan mengenepikan kepentingan diri, berjuang untuk menentang kezaliman dan penindasan . ini secara tidak langsung berkeupayaan menjamin keharmonian dan kesejahteraan rakyat.Sebab itu, gerakan islam perlu diperhebatkan. Masyarakat islam harus ditekankan dengan konsep akhlak islamiyah dan membangkitkan kesedaran mereka tentang kewajipan muslim untuk menjadikan islam sebagai suatu cara hidup yang lengkap dan addin yang membawa rahmat. Ini bukan soal yang boleh dipandang enteng atau remeh. Usaha ini pastinya sukar melihatkan ‘gelagat’ anak-anak muda masakini. tetapi demi memastikan kesejagatan ummah itu terpelihara, kita tidak punya pilihan. Kita harus singkap dan renung kembali bagaimana rangkaian gerakan islam dari timur tengah termasuk di Indonesia mengatur strategi untuk memperbetulkan akhlak masyarakat yang rendah akal budinya. Bukan berniat untuk meremahkan gerakan islam di Malaysia sekarang tetapi pada hemat saya secara peribadi, ianya perlu diperluas dan diperkasakan. Tindakan kita sekarang akan mencorakkan situasi puluhan dan ratusan tahun akan datang.

Rakyat Malaysia sebenarnya mempunyai kecendurangan dalam memberikan pendapat yang terlampau dipengaruh dengan sentimen kepartian. Sebagai contoh, kebanyakan penyokong Pakatan rakyat akan menyokong segala pendapat pemimpinnya dan menolak bulat-bulat pendapat pemimpin Barisan Nasional. Begitu juga sebaliknya. Kita tidak terbuka untuk menilai idea pihak lain. Kita merasakan hanya pihak yang kita sokong sahaja betul. Ini pemikiran di bawah tempurung yang menyekat kebebasan berfikir. Kadangkala bila kita menyokong pendapat Anwar, kita akan dilabel pembangkang dan pengkhianat kepada kerajaan. Bila kita menyokong pendapat Mahathir orang akan melabel kita orang UMNO. Bilamana seorang pemimpin pembangkang menyatakan sokongan kepada idea kerajaan, dia akan dianggap mahu melompat parti.

Penyokong kuat Mahathir sama sekali menentang dan tidak boleh menerima walau satu idea dan pendapat Anwar. Begitu juga sebaliknya. Sebab itu , kebanyakan rakyat Malaysia memberikan pendapat tentang suatu isu dipengaruhi oleh sentiment kepartian. Ini menghalang kita berfikir secara terbuka. Lihat shaja media. Utusan Malaysia semua mengampu kerajaan dan mencela pembangkang. Harakah hampir seratus peratus mengkritik kerajaan seolah olah semua yang dibuat salah. pas dikatakan memperjuangkan kebebasan media tetapi harakah juga tidak tebuka sebenarnya. Barangkali mengikut contoh utusan dan berita harian. Sebab itu, dalam soal pendapat kita harus terbuka dan rasional. jangan anggap orang yang menentang sesuatu idea kerajaan, terus akan dilabel sebagai pembangkang. Isu PPSMI umpamanya, a samad said yang menentang idea tersebut akan dituduh sebagai orang pembangkang dan penyokong pakatan rakyat. Ini budaya pemikiran tertutup dan jumud.

While I was in uitm, many law students speak English fluently and make it as a language for daily conversation. This indirectly help me to improve my English by communicating with them. Right now, I live in an environment where most of the people cant speak English. i dont mean to underestimate but that is the truth. maybe i never heard. How can I improve my English? This makes me quite worry and im still thinking the way to speak very fluent.

Ability to speak English fluently is a an important skill which only certain people have it. This skill is essential due to the reason that, English is a global language. English is used as medium of communication in the entire world. It can be said that English is the most used language in the world. In Malaysia, all students are compulsory to take English subject. All Malaysia students learn English for 11 years.

Not all people can speak English fluently even though we have learned it quite long. People who can speak English will have good impression and respected. In my view, some Malaysians cant speak English because they don’t use it in daily life. They use malay all the time and become used to that language. Malay is their official language while communicating and they use English very seldom.

The way to improve English is only one word. Application. Language need to be applied. In other word, it need to be always used. When we always use that language, we will become used and comfortable to the language. Everything that we want to convey will automatically appear in our mind if use that all the time. Everything in the mind must be in English. What we say to ourselves must be in English. So that, we got no problem in communicating in English because every single words in our mind are in English which implicitly make the words that we want to say appear automatically.

Talk to yourself in English ,thinking in english and make everything in my mind in English is my own way to improve that language. As a lawyer( god willing) to be, it is compulsory for me to be able to speak English. Lawyer need to deal with clients and arguing in the court. Some of the clients might speak English and certain judges tend to use English. Lawyer has no choice. By hook or by crook, i need to have that ability. lets hope and pray for that.

Masyarakat islam harus ditekankan dengan konsep akhlak islamiyah dan membangkitkan kesedaran mereka tentang kewajipan muslim untuk menjadikan islam sebagai suatu cara hidup yang lengkap dan addin yang membawa rahmat. Ini bukan soal yang boleh dipandang enteng atau remeh. Usaha ini pastinya sukar melihatkan ‘gelagat’ anak-anak muda masakini. tetapi demi memastikan kesejagatan ummah itu terpelihara, kita tidak punya pilihan. Kita harus singkap dan renung kembali bagaimana rangkaian gerakan islam dari timur tengah termasuk di Indonesia mengatur strategi untuk memperbetulkan akhlak masyarakat yang rendah akal budinya. Bukan berniat untuk meremahkan gerakan islam di Malaysia sekarang tetapi pada hemat saya secara peribadi, ianya perlu diperluas dan diperkasakan. Kematangan meupakan sesuatu yang subjektif. Umat generasi muda mentafsir kematangan sebagai cool. Jika dahulu, seseorang yang punya sikap kedewasaan seperti pandai berkomunikasi, beretika, suka berbicara tentang isu semasa, dan mudah bergaul akan diannggap matang. Pendekatan pentafsiran perkataan matang ini telah berubah sejajar dengan kemodenan manusia. Anak-anak muda sekarang mengguna pakai perkataan cool sebagai memeperlihatkan kematangan dan kewibawaan seseorang. Apa sebenarnya kayu ukur atau elemen yang boleh kita katakan sebagai cool? Melalui pemerhatian, generasi sekarang melabel seseorang yang coo l mestilah bersikap gila-gila, riang tetapi ada kalanya serius, gemar berjenaka, suka muzik indie, berfikiran liberal atau tidak konservatif, dan juga semestinya gemar melepak serta banyak lagi elemen lain yang tidak mungkin saya sebutkan semuanya . dalam merentas arus dunia kompetan masa kini, Malaysia menuju pesat ke arah sebuah negara maju menjelang 2020. gagasan ini cetusan tun dr mahathir yang bakal menobatkan Malaysia sebagai negara dunia pertama. untuk mencapai gagasan ini bukanlah suatu tugas yang mudah. ianya memerlukan semangat daya juang dan daya tahan yang luar biasa. jika diimbau sejarah, kebanyakan bangsa mengambil masa cukup lama untuk membina tamadun. Rome tidak dibina dalam masa sehari. kita memerlukan semangat menyeluruh yang berterusan.

pengurusan ekonomi yang baik merupakan suatu kayu ukur kepada negara maju. waktu ini, pertumbuhan ekonomi agak perlahan. ini adalah fakta. kita seharusnya tidak boleh berpuas hati dengan kadar pertumbuhan ekonomi sekarang. kini , kita hidup dalam khayalan. catat ekonomi lima peratus kita anggap sudah cukup tinggi dan sukses. ekonomi kita katakan cukup stabil. pada persidangan asean 2006, dalam indeks pelaburan kita nombor 4. angka ini mungkin lapuk dan tidak relevan tetapi sekadar untuk memberi peringatan bahawa ekonomi kita perlu diperkasakan.

sekitar 80an, kedudukan ekonomi kita setanding dengan korea selatan, taiwan dan singapura. sekarang?? negara-negara tersebut melonjak naik menjadi negara gergasi ekonomi. sebab itu, saya katakan kita harus tarik pelabur-pelabur asing untuk melabur di negara ini dan galakkan pelabur2 tempatan untuk melabur semula dalam negara. ini pada hemat saya mampu menjana kekuatan ekonomi kita. suntikan pelaburan yang luar biasa bakal mengubah suatu bandar baru menjadi pesat membangun, sebuah pekan di pedalaman berubah menjadi bandar tumpuan, dan sebuah bandaraya menjadi kota metropolitan. pelaburan bukan sekadar menjana ekonomi, tetapi juga memberi pulangan kewangan kepada kerajaan dan rakyat yang akan mendapat manfaatnya.

zaman ini, generasi muda hidup dengan kemajuan teknologi. situasi berubah terlalu drastik. arus moden menyebabkan persekitaran cukup berlainan dengan masa lalu. ini hasil daripada perkembangan ilmu yang diaplikasikan untuk kemudahan masyarakat. keupayaan dan kebolehan untuk menguasai ilmu dengan cukup meluas pastinya mampu disumbangkan untuk membina tamadun dan membangunkan masyrakat madani. masyarakat kini semakin tinggi pendidikan mereka. jika dahulu, masyrakat malaysia kebanyakannya tidak berpendidikan tinggi. tetapi, kini golongan profesional itu cukup ramai. ini memperlihatkan perkembangan negara dari sudut taraf pendidikan pendudk daripada zaman baru merdeka hinggalah sehingga 51 tahun merdeka.

golongan berpendidikan dianggap profesional. mereka juga dianggap intelektual. pandangan mereka selalu diambil kira disebabkan ketertinggian ilmu mereka. tetapi bukan semuanya boleh berfikir dengan baik. kadangkala mereka ini sengaja mengelirukan diri sendiri. bukan semua golongan berpendidikan terbuka pemikiran mereka. ada juga yang masih terkepung dalam kerangka pemikiran sempit. ada ketika, pandangan yang dikemukakan tidak masuk akal. cadangan kadangkala tidak logik dan munasabah secara tidak langsung memperlihatkan kelemahan mereka berfikir. pemikiran mereka kadangkala tidak setaraf sengan ketertinggian ilmu mereka. bila ini berlaku, kadangkala ia melucukan kerana timbul persoalan bagaimana seorang yang punya pengetahuan cukup luas boleh lemah berfikir jika dilihat dari segi memberi ulasan tentang sesuatu isu, memberi cadangan, dan berbahas. adakah mereka sendiri mengepung minda mereka agar tertutup rapat.

bila bercakap golongan berpendidikan, generasi muda adalah sebahagiannya. mahasiswa adalah golongan yang aktif dan agresif. pada hemat saya secara peribadi, saya berpandangan bahawa generasi muda sekitar 70an itu cukup terbuka pemikiran mereka. mereka cukup peka dengan keadaan semasa baik politik, ekonomi, sosial, bahasa, dan pendidikan. kelantangan mereka cukup memberi kesan kepada kerajaan pada ketika itu. ini memperlihatkan idealisme mereka yang mahukan sebuah negara bertamadun, ekonomi pesat, rakyat tidak miskin, dan sistem sosial yang stabil.

apa jadi generasi muda sekarang? ya.. ramai daripadanya berilmu dan berpendidikan. tetapi adakah generasi muda sekarang berperanan sebagai penggerak kepada masyarakat? berdasarkan pemerhatian, belia telah gagal. mereka kini kurang peranan. mereka dilihat lesu dan lemah jika dibandingkan anak anak muda masa lalu. lihat sahaja belia sekarang, bila ditanya soal adakah kamu peduli tentang kemiskinan? tanya mereka soal politik.. tanya mereka soal akhlak dan keluhuran budi. apa mereka kisah semua itu?? mereka kini bicara soal hiburan, soal lagu-lagu masa kini, para artis, dan gosip. semua ini geli dan jijik mendengarnya. mereka masih terbuai dan terlena dengan budaya berseronok keterlaluan tanpa mengambil bicara status mereka sebagai belia yang sepatutnya berperanan untuk kemajuan negara. pelik sungguh.. mereka berilmu tapi bicara kerap kali soal AF dan sebagainya. semua ini hampas dan sampah serta memalukan.

ini memperlihatkan kedangkalan ilmu mereka. arus permodenan yang sepatutnya mematangkan sebaliknya menjumudkan pemikiran. hambatan dan serangan hiburan menjadi suatu penyakit yang melekakan minda. pemikiran yang terjajah begini sebenarnya suatu kerugian besar kepada negara. minda anak-anak muda cukup dinamik dalam menggerakkan negara. sebab itu, jika pemikiran hedonisme anak muda terus dibiarkan, maka implikasinya adalah pada masa akan datang. kata yusof qhardawi, bila mana kita mahu menjangka kepimpinan negara di amsa depan, maka lihatlah anak muda sekarang. tindakan kita sekarang bakal mencorakkan situasi puluhan dan ratusan tahun akan datang. jika belia sekarang berpikiran jumud, bagaimana mereka akan memimpin di masa akan datang. jika remaja sekarang rendah akhlak dan akal budinya, bagaimana situasi masa depan.

untuk membina tamadun dan mewujudkan masyarakat hadharah, mestilah berteraskan kepada keseimbangan pembangunan fizikal dan akhlak. pembangunan hanya satu unsur tidak akan memberi apa2 makna. ekonomi pesat membangun akan runtuh jika rasuah dan penyalahgunaan kuasa dibiar menular. maknanya, pembangunan fizikal wajib seiring dengan pembangunan insaniah. kata prof mohd iqbal, sarjana islam terkenal indonesia, jangan kita ini membangun sambil merobohkan. kita bangunkan gedung gedung, industri besar dan bangunan pencakar langit, tapi dalam masa yang sama maksiat kita biarkan merebak, rasuah menular dan penyelewangan menjadi kebiasaan. ini pastinya mengakibatkan timbul bibit kelemahan yang seterusnya akan membawa kehancuran.

tidak ada guna anak-anak muda yang berilmu, tetapi berminda dangkal, terpedaya dengan hiburan, rendah akhlak dan akal budi. maksud ketamadunan tidak akan tercapai. adalah cukup memalukan melihat pemikiran generasi sakarang jika dibandingkan dengan generasi 70an. jika ini terus terusan berlaku, mereka akan jadi seperti pepohon tanpa hasil. mereka punya ilmu tapi malangnya tidak dimanfaatkan untuk berfikir dengan minda terbuka.

keunggulan sesuatu tamadun itu bergantung kepada kekuatan ilmu dan keupayaan mengaplikasi pengetahuan pada kadar tertinggi. sejarah memperlihatkan sedemikian sejak daripada zaman tamadun greek, rome dan juga beberapa tamadun islam. kegiatan perkembangan ilmu dan penubuhan institusi-institusi pendidikan membantu membentuk suatu budaya baru, meningkatkan kesedaran tentang kepentingan ilmu yang membantu kemajuan fizikal sesebuah tamadun. pendidikan juga telah secara tidak langsung membuka pemikiran masyarakat untuk berminda liberal. anak-anak muda sebelum merdeka lulusan luar negara bangkit enjadi pejuang bangsa memerdekakan negara dari cengkaman imperialisme. tokoh-tokoh besar ini mewujudkan suatu kesedaran baru kepada masyarakat tentang implikasi buruk akibat penjajahan yang membobrokkan negara dan merugikan pemilik sesebuah tanah air.

masyarakat yang tidak berilmu sebenarnya maih terkepung dalam kerangka pemikiran sempit. mereka sebenarnya telah tertup pemikiran dan terperangkap dalam kerangka minda di bawah tempurung. masyarakat sebelum merdeka rata-rata nya tidak berilmu. bila mana jepun melaungkan slogan asia untuk asia, mereka terpukau dengan tidak menyedari bahawa ia hanyalah retorik semata mata. hanya bebrapa kelompok golongan yang berpendidikan yang tidak terpana dengan ungkapan ini.

masyarakat pasca kemerdakaan kebanyakannya berpendidikan. lebih-lebih lagi golongan belia dilihat sebagai tenaga penggerak besar untuk negara. Bung Karno pernah menyatakan jika diberikannya 10 orang pemuda beliau bisa menggoncang dunia. kata-kata ini jelas menggambarkan bahawa anak muda merupakan golongan yang agresif dan energatik dalam membawa perubahan ke arah kebaikan.

belia di sekitar 70-an cukup agresif terutamanya mahasiswa. mereka bangkit sebagai golongan pembela hak masyarakat awam. keupyaan mereka menyuarakan ketidakpuashatian terhadap kemiskinan, isu bahasa, dan nasib petani itu cukup memberi kesan kepada pemerintah berkuasa. kegelisahan generasi muda pada ketika itu tentang isu-isu tesebut telah menyebabkan fungsi mereka dalam membela hak itu cukup ketara. demonstrasi 74 telah membuktikannya dimana, selepas itu kerajaan telah merangka pelbagai usaha untuk mengatasi kemiskinan para petani, pendidikan dan sebagainya.

bagaimana generasi sekarang yang dianggap sesetengah pihak sebagai dungu dan dangkal walaupun berilmu? bersambung..

kekuatan rakyat dalam sesebuah negara diperlihatkan melalui proses pemilihan pemimpin. ungkapan kuasa rakyat bukan merupakan sesuatu yang baru. pemimpin berkewajipan menyuarakan masalah dan pendapat rakyat. kepimpinan dalam konteks negara demokrasi harus membela nasib rakyat. kerajaan beramanah, adil, dan bertanggunjawab sememangnya merupakan suatu impian bagi seluruh rakyat. jika elemen ini dipenuhi, maka 'kerajaan rakyat' akan dapat dibentuk. Abraham Lincoln pernah menyatakan dalam pidatonya, kerajaan demokrasi adalah kerajaan oleh rakyat, dan untuk rakyat. pertanggunjawaban dalam berkebajikan mengembalikan hasil makhsul negara, mengagihkan pendapatan negara secara telus yang sememangnya menjadi hak rakyat keseeluruhannya bukan hak pemimpin-pemimpin berkuasa.

dalam menguruskan dana pendapatan negara, penguasa memerintah harus bersikap betanggungjawab. prinsip ketelusan harus menjadi suatu keutamaan. mengagihkan kekayaan negara merupakan suatu amanah besar yang menjadi taklif berat kepada kerajaan. dalam pilihanraya, kerajaan diberikan mandat dan kepercayaan penuh untuk mentadbir negara. di antara tugas-tugas utama kerajaan termasuklah membentuk sesuatu dasar untuk manfaat rakyat, memperbaiki struktur sistem sosial, memelihara keharmonian berlunaskan perundangan dan juga menguruskan wang rakyat.

dalam menguruskan hasil makshsul, perlu diingat, jumlah tersebut sememangnya menjadi hak mutlak rakyat. sumber khazanah yang melimpah, institusi pecukaian daripada syarikat-syarikat antarabangsa, tempatan dan rakyat merupakan di antara sumber pendapatan negara yang bertujuan untuk memacu, menyeimbangkan ekonomi untuk kebajikan semua rakyat. bila mana disebut hak rakyat, maka pengurusan kewangan negara harus bertujuan untuk menguruskan pendapatan negara secara beramanah untuk dikembalikan semula kepada rakyat atas prinsip keadilan dan pertanggungjawaban.

dalam konsep kerajaan, tugas utamanya adalah untuk menjaga hak rakyat. semua negara-negara di dunia mengutamakan konsep sedemikian. bila disingkap kembali sejarah, bermula daripada tamadun tamadun besar di dunia, semuanya itu mengutamakan konsep begitu. taklif wa la tashrif bermakna tanggungjawab, dan bukan keistimewaan. pemimpin pemimpin berkuasa mempunyai tanggungjawab besar diamanahkan oleh rakyat dan bukan pemilihan itu bertujuan sama sekali untuk menikmati keistimewaan. bersambung...

Bagi kebanyakan peminat sukan bermotor, Nissan skyline, Mitsubishi Evolution, dan Nissan Cefiro merupakan di antara jenama-jenama besar yang sangat popular. Di kebnyakan negara-negara pengeluar kereta seperti Jepun dan Jerman, industri sukan bermotor merupakan suatu kelaziman didorong oleh lambakan jenis kereta ternama dan harga yang mampu di miliki oleh golongan biasa dan sederhana. Alatan ganti kenderaan juga berada pada tahap yang munasabah dn secara tidak langsung modifikasi kenderaan dapat dilakukan pada kadar yang kerap untuk meningkatkan lagi prestasi kenderaan.

Di kebanyakan negara-negara membangun, sukan ini masih setahun jagung. Di Malaysia umpamanya, kebnyakan peminat sukan bermotor terutamanya golongan berpendapatan sederhana terpaksa membelanjakan sebahagian gaji mereka hanya untuk sukan ini termasuk untuk mengubah suai dan menukar atau manik taraf alat ganti.

Untuk pengetahuan umum saya baru sahaja memiliki Proton Satria 1.3cc. beberapa pengubahsuain telah dilaksanakan termasuk menukar ekzos, kotak gear, stereng, dan exterior modification. Penukaran ekzos, dan beberapa pengubahsuain enjin( engine tuning) telah meningkatkan kadar penggunaan minyak (fuel consumption). Secara keseluruhannya, pengawalan(handling) kereta cukup baik tetapi kebolehan memecut sedikit mengecewakan memandangkan cc yang rendah. Berikut saya paparkan maklumat dan fakta tentang proton satria.

The first generation Satria was based a 3-door hatchback on the 1991 Mitsubishi Mirage (Colt outside the Japanese market). Changes were limited to front-end styling and interior from the bigger Wira. Powerplant options included the 4G13p 1.3-litre 12-valve, 4G15p 1.5-litre 12-valve and 4G92p 1.6-litre 16-valve SOHC engine. The 1.5 and 1.6-litre 16v versions were also available with optional 3-speed and 4-speed automatic transmissions respectively.

Trim levels were LSi, GLi, GLSi and SEi. The base-specification LSi had the 1.3-litre 12-valve engine only: GLi versions got the 1.5-litre 12-valve engine in addition to the 1.3-litre: whilst GLSi and SEi versions got the 1.6 16v engine as well as the 1.5 12v.

Look at how the British are in the House of Commons and you'll see how a great democracy works. We're all human beings and we must respect each other even if we don't believe the same things. let the Parliament work as a democratic parliament. This song is called Romance, by Narciso Yepes. he plays very well-done- but his "innovation" does not fit in well.. I liked the personal touch he added to the piece. he plays it in an interesting rythm too.. anyway, he plays very good but i think its better off if he played it in ori version(minus the too much strumming and drumming of the strings). well that's just me... i feel sad when i listen to this great man!!

Have you heard a news that perodua will produce a new suv? Yaaa.. that will become reality soon. Perodua has officially unveiled the name of the new Perodua which is perodua nautical. This little SUV is based on the short wheelbase Daihatsu Terios. The long wheelbase version is also on sale in our local market in the form of the Toyota Rush. Can we call this ciplak?

Question running in my mind, why does perodua takes daihatsu’s car to make their own new model. I see all of our local production car company (proton and perodua) do the same thing. Take a model from japan. And then, make a little changes to the car. Daihatsu logo will be perodua logo. The same thing also happen to proton. Mitsubishi car will be proton car. After that we claim that it is our national car. We make it by ourselves. Using our expertise. Our engineers are the men behind our success in producing our own car. Hey… kamon la…. People are not stupid. They know everything. Don’t we feel shame?? How about if Japanese visit our country and find their car on the road with a different logo. Not Daihatsu logo, but proton logo. They will become curious and ask when did Daihatsu change their logo. Don’t we feel shame with such this situation? The issue now, what actually our experts do? They said, research and development had been made. So, prove it. Don’t just seek help and take other’s car because that’s mean you cheat people. People want something new. Readers, do you know where Viva and Myvi derive? Both of them based on Daihatsu also. And do you know when Daihatsu started selling that car? 1999. already outdated right? But some buyers don’t know. Although they know, they have no choice. Other CBU cars are expensive. they can’t buy Toyota, Mercedeze, or BMW since their purchasing power doesn’t allow them to afford it. Yesterday I watched malay movie, anak halal on youtube. Sorry to the producer for not buying the ori vcd. But that doesn’t mean I’m not supporting our entertainment industry. But, it should be noted, everyone would act in the same manner if they face situation like me.

So now, what I’m going to do? Since I’m quite boring right now I want to express my opinion about this movie. First word comes to my mind regarding this film is… rubbish. Before I watched anak halal, I guess I would be entertained and learned something new. But….. aiya… I also don’t know la how to describe my feeling. You watch it by yourselves la. It seems that all of malay films (except afdlin shauki’s films) are useless and not able to contribute for the development of human dignity, social system and society as well. Huarghh( menguap) . Sorry, I start to feel lazy,sleepy and tired to write my own opinion even though I had mentioned it before. And I also don’t have time because I said to my friends that the construction of this blog will be completed today. Anyway, I want to share to all of you about an article analyzing this film from various scopes. To all readers. my advice; read carefully and think about it.

Anak Halal: 'Godless & Hopeless'

Begini, kesenian Melayu-Islam yang menjadikannya indah ialah kerana bentuk, kemudian kandungannya, dan kemudian rasa yang dijambatani oleh kita dan semua hal tersebut dijalin oleh faedah dan manfaat. Nah, faedah dan manfaat itu yang mustahak. Tikar mengkuang sekali pun, kain batik sekalipun meski diciri oleh estetika yang menakjubkan akhirnya mesti dicipta untuk memberi faedah. Kain batik yang cantik tetapi dicipta untuk tidak memberi faedah maka ia sia-sia.

Begitu jugalah karya sastera, atau karya filem. Mengambil kira 50 tahun merdeka, semua dari kita ingin kembali kepada jatidiri sendiri. Mahu merdeka dari kejahilan dan kebatilan serta kebodohan yang pernah dipantakkan kepada kita dulu. Filem juga mesti kembali kepada keindahan bentuk, kandungan, rasa dan mesti berfaedah.

Anak Halal sebuah filem yang sia-sia. Pembikinannya sia-sia, terlibat dalamnya sia-sia. Hasilnya juga sia-sia. Justeru menontonnya juga sesuatu yang lagha.

Tetapi untuk mereka yang tiada Tuhan, filem 110 minit dengan adegan rogol, peluk sana sini (ingatan: dakap dan gomolnya jauh lebih ganas dari Gubra!), main dadah (kononnya untuk tunjukkan dadah itu memusnahkan tetapi penonjolan dadah itu sendiri menghairankan kita!), adegan berkemban dan tak pakai baju, rempit dan kemungkaran, gangsterisme, bunuh-membunuh, adegan separuh Hindraf (iaitu ganas tidak bertempat), serta pagi tanpa subuh berleluasa di sana sini tentulah mereka gemari.

Ingat; kerangka yang saya guna ialah bukan kerangka bentuk, kandungan dan rasa lagi, kerangka yang saya gunakan disini ialah sebagai 'ciptaan Tuhan yang mencipta' kita melakukan sesuatu semuanya untuk memberi faedah, lagi bermanfaat.

Tidak pernah saya menonton filem seburuk ini. Rasanya Nana Tanjung 10 kali lebih senonoh dari filem batil ini. Malahan kata teman saya, menonton Impak Maksima 20 kali pun lebih baik dari menonton kisah gila ini. Betul, Anak Halal sebuah filem yang sedang ditayangkan di panggung kala ini adalah sebuah filem yang tiada jatidiri. Sesekali macam berkiblatkan Hong Kong, sesekali pula macam berkiblatkan Bollywood, ada sentuhan macam nak jadi Indonesia, juga macam nak jadi Hollywood dan disuntik sana sini pesan yang kononnya bermaruah iaitu supaya jangan hancurkan anak bangsa dengan dadah. Kecelaruan identiti begitulah kesimpulannya.

Aspek naratif? Hancur bersepai! Plot filem ini lemah dan kelam kabut serta tiada arah. Watak dan perwatakan mendatangkan geli geleman dan dialog tidak lojik seperti ingin hidup di Zuhal atau ingin terbang ke Kejora diucapkan demi memberi sentuhan artistik. Puitis la konon!

Pengalaman membaca dan membimbing cerpen pemula dari budak-budak Minggu Penulis Remaja, macam itulah jalan cerita dan plot filem ini. Plot macam budak tak pernah belajar menulis. Penuh dengan klise (anak orang kaya mesti tak cukup kasih sayang!), formula karut (zina, penagihan dadah dan penderitaan ala Bersama-Mu untuk menagih simpati dan tangsian penonton), serta melankolia geli anak tekak (seperti adegan cinta yang busuk). Eloklah pengarah-pengarah filem kita masuk berkursus dulu, masuk berkursus penulisan dengan Saharil Hasril Sanin pemenang Hadiah Sastera Berunsur Islam DBP pun tak apa. Upah Saharil mengajar apa itu logos dulu kalau pun tak kenal erti ethos.

Begini, sebab dan akibat yang lemah itu biar saya huraikan, (ingat dari segi naratif filem, plot yang bodoh, tidak lojik dan merapu adalah bukti kelemahan sesebuah filem): Hisham seorang penjenayah telah menyerahkan bayi lelakinya kepada Mariam, seorang perempuan gila di jalanan. Hisham telah ditangkap dan dipenjarakan. Mariam membesarkan bayi tersebut (Putra) dalam kemelaratan. Tinggal di kawasan kumuh yang kusam, berjirankan Bu Leha dan anak perempuannya, Johanna. Dari zaman kanak-kanak, Putra dan Johanna bersahabat rapat. Selepas Mariam diambil oleh Jabatan Kebajikan Masyarakat, Putra dibesarkan oleh Bu Leha. Putra dan Johanna membesar menjadi remaja jalanan. Putra bertugas di sebuah kedai potong, sementara Johanna dan ibunya berniaga di Pasar Chow Kit.

Huraian Pertama: Cerita dengan watak kerdil akan mengakibatkan pemikiran yang dihantar juga kerdil. Watak kerdil tak pernah dapat berfikir besar, sebab itulah bila Mariam merindui Putra, dia berangan nak terbang ke bintang Kejora (dengan air mata bertakung). Memang menyampah dan meluat betul. Kerana itu jugalah kita lihat watak-watak ini duduk dalam lingkungan kemungkaran dan tak pernah mahu keluar darinya.

Tak cukup-cukup ke filem Melayu atas nama realisme (yang konsep dan falsafahnya menyalahi Islam itu) menonjolkan realiti seperti pelacur, rempit bohsia, penagih dadah? Tak cukup-cukup ke? Korang yang tengok tak muak-muak ke?

Lebh keji, lebih tiada Tuhan ialah apabila voice over di hujung filem ini menyatakan - setiap manusia ada takdir sendiri - cis biadab! Seolah-olah keadilan Ilahi dicabar dalam filem ini. Watak-watak yang tiada harapan ini menyalahkan Tuhan pula. Kerana Tuhan dah takdirkanlah maka mereka hisap dadah, kerana Tuhan dah takdirkanlah mereka jadi pembunuh dan penjenayah, kerana Tuhan dah takdirkanlah maka mereka berpeluk bercium tak sudah-sudah. Kerja menyalahkan Tuhan ini menunjukkan pengarah-pengarah filem di Malaysia tak faham agama Islam.

Sewaktu mengajar di Sekolah filem UiTM dulu, sewaktu mengajar Farid Kamil dulu saya pernah mencadangkan supaya sekolah filem mengajar subjek agama dan subjek sastera tradisional. Tujuannya supaya tak ada karyawan filem buat drama sia-sia dan penuh dengan sundal macam Spa-Q, atau supaya tak buat cerita hantu dan mengagungkan khayal serta khurafat, atau tak buat skrip macam Jelatang yang di akhir setiap episod penulis skrip berpesan supaya kita bertaubat (dia yang buat cerita tak senonoh kita pula disuruh bertaubat!). Dan supaya mereka kenal jati diri bangsa menerusi hikayat lama seperti Sulalatus Salatin. Tetapi cadangan itu dipandang sepi. Malah diremehkan dengan kata-kata 'nak jadi tukang filem buat apa belajar agama'. Begitulah kalau sudah tak kenal hukum. Disiplin apa pun kembali kepada Tuhan. Kaji alam macam bidang geografi pun akhirnya dapat jumpa Tuhan, patutnya begitulah juga dengan dunia filem.

Ini satu hal yang menyesakkan, sekolah filem di UiTM, sekolah filem di Aswara, sekolah filem di USM dan UM mesti menyediakan asas pemikiran bangsa dari awal lagi. Sila jemput Mufti Perlis yang banyak kepandaiannya itu untuk mengajar karyawan filem yang tak ada arah ini, ajarkan mereka doktrin Inna lillah wa Inna ilaihi Rajiun. Ajarkan juga konsep min aina, fi aina dan ila aina. Sebab pengarah filem dan pelakon filem pun ada Tuhan dan akan mati satu hari nanti. Sekolah filem kita mesti mengajarkan rukun iman. Ini tidak, karyawan filem kita buat filem macam tak kenal adanya hari kiamat! Astaghfirullah, karyawan seni kita makin tak ada Tuhan ke?

Kalau tak, pengarah filem kita akan buat kerja sia-sia lagi. Dan duduk dalam putaran keji yang serupa. Kemudian sesama mereka akan ampu dan angkat sesama sendiri. Syok sendiri.

Huraian Kedua: Johanna membesar sebagai seorang gadis tomboi, dalam diam menyukai Putra. Tetapi Putra pula jatuh cinta dengan Amiera, anak orang kaya yang dikenali mereka secara kebetulan. Amiera walaupun disaluti kemewahan tetapi hidup dalam kesunyian. Mereka sering melepak bersama. Mereka bahagia hidup dalam dunia mereka sendiri.

Lihatlah stereotaip yang tidak pernah bebas dari filem Melayu. Sebab dan akibat yang sama tak sudah-sudah, langsung tiada kreativiti. Tolonglah beri anjakan paradigma sedikit wahai orang filem!

Huraian Ketiga: Erzan salah seorang rakan mereka, sedang dibelenggu masalah hutang dengan along dan diugut supaya melangsaikannya segera. Suatu hari ketika sedang melepak dan tergedik-gedik di kelab malam, mereka ditangkap dan ditahan di lokap (maka ada alasanlah untuk hero-hero filem ini ditampilkan dalam adegan tak pakai baju dan hanya pakai boxer) .

Bapa Amiera begitu marah dan tidak membenarkan Amiera keluar dari rumah. Amiera yang tertekan (memang macam cerpen yang biasa editor Dewan Siswa reject!), disamping ketagihan dadah telah melarikan diri. Amiera bertemu Erzan. Mereka sama-sama khayal dengan dunia dadah mereka. Keesokannya Putra yang terjumpa mereka berdua telah naik angin. Amiera melarikan diri. Setelah puas mencari, Putra bertemu Amiera dalam ketagihan yang amat teruk. Amiera minta Putra membawanya ke tempat dia sering mengambil bekalan, di Kg. Kayu Ara. Putra bersetuju kerana dia mahu tahu tempat dan orang yang telah merosakkan kawan-kawannya itu.

Jeng-jeng orang yang merosakkan kawan-kawannya ialah bapanya sendiri, yang sudah keluar dari jel. Tak ke klise! Macam filem Tamil, malah filem Tamil pun sudah jauh lebih bermutu.

Kemudian untuk menambah rasa jengkel kita, Amiera yang sedang khayal dek dadah di bumbung flat tempat Putra tinggal telah mengejar bunga api dilatari KLCC lalu jatuh dan mampus di situ juga dalam hujan yang lebat. Inilah kemuncak tiadanya moral dalam filem Melayu, sangat hadhari sifatnya.

Putra yang bertambah marah dengan kesan dadah ke atas kawan dan kekasihnya telah membawa geng untuk bergaduh dengan kumpulan along, maka jadilah adegan ala-ala The Departed atau Young and Dangerous yang merepek merapu.

Kemudian plot menjadi seperti filem Bangla semula, Putra nekad ke Kg. Kayu Ara mahu membunuh mereka yang terlibat. Niat Putra terlaksana apabila dengan mudah dapat membunuh Hisham, ketua kumpulan pengedaran dadah tersebut. Tiba-tiba muncul wanita tua yang sekian lama dirindui Putra, Mariam. Selama ini rupa-rupanya Mariam telah dijaga oleh Hisham, dan mereka berdua tidak pernah berputus asa mencari Putra. Oh Putra membunuh atau terbunuhkan bapanya sendiri. Oh sedih-sedih, penonton dipaksa bersedih. Saya kira inilah naratif filem yang paling memperbodohkan penonton pernah saya tonton.

Bunuh sana sini dalam filem ini kita pun tertanya, polis Malaysia yang cekap itu di mana, di hujung barulah muncul polis dengan kereta peronda. Saya kira filem ini juga menghina slogan cepat mesra betul polis. Kasihan polis. Padahal polis di Malaysiakan cekap dan baik? Sampai hati kutuk polis diam-diam begini.

Kerja seni bukan kerja setakat menyusun bentuk, mengisi kandungan dan menampilkan rasa. Kerja seni macam mesin basuh juga mesti memainkan peranannya. Setakat mahal, nampak bergaya dan penuh estetika tetapi tiada fungsi itu namanya tak berguna, dan benda tak berguna adalah sia-sia.

Kembali kepada voice over Putra di akhir filem yang menyalahkan takdir tadi, inilah kesesatan sekolah pemikiran hasil daripada ketidakfahaman terhadap konsep keadilan Ilahi. Ini kesan kerana ustaz-ustaz kita dari dulu asyik mengajar sifat 20 dan ini kesan kerana ustaz balik dari Madinah dan Jordan kebanyakannnya bertengkar tahlil itu bid'ah ke tidak, ada filem macam gampang; tak siapa pun peduli. Agamawan kita seronok nak bid'ahkan orang, mungkar tertonggok depan bijik mata buat tolol. Mengapa harus dikritik golongan agamawan pula? Kerana ulama sepatutnya memimpin dan menjadi sentral dalam kehidupan khususnya aspek budaya seperti yang dilakukan wali songo. Agamawan yang mandul dan diam sama sahaja malah setara dengan karyawan seni yang mungkar. Syaitan bisu.

Wahai pengarah filem, kalau ya pun mahu berjaya di peringkat internasional dan menang di pesta filem antarabangsa janganlah hina diri sendiri.

Filem kita tak akan mampu menandingi filem Barat dari segi teknologi. Dari segi kandungan dan bentuk serta rasa, kita punya tafsiran sendiri-sendiri (untuk mereka yang tiada Tuhan tentu berbeza dengan yang ada Tuhan), tetapi dari segi faedah dan manfaat, kitakan Melayu-Islam, faedah dan manfaat itu kembali kepada tauhid, kepada Nabi, kepada keluarga baginda.

Sebab itu sekolah filem kita mesti mengajar epistemologi. Kenal kamera sahaja tak memadai. Kamera tanpa Tuhan adalah kerja sia-sia. Harap Profesor Madya Abdul Razak Mohaideen dan Dr Abu Hasan dapat pertimbangkan. Kamera harus bersekali dengan Tuhan. Itulah yang menjadikan kesenian kita berbeza dengan kesenian Barat dan bukan Islam, iaitu kita tidak habis setakat bentuk, kandungan dan rasa sahaja, ada lain di sebalik itu semua. Itulah kelainannya.

Godless dan Hopeless tema yang sesuai untuk Anak Halal (tema ini berturutan sejak Bukak Api, Puaka Tebing Biru dan terbaru filem ini). Mesej besarnya, kalau hisap dadah tak apa, ini kerja takdir, Tuhan dah takdirkan untuk hisap dadah jadi nak buat macam mana. Atau kalau nak melacur pun melacurlah, dah takdir. Nak buat macam manakan?

Memang kerja sia-sia.
